AGENDA ADMINISTRATIVE HEARING

Public Meeting Date & Time: Thursday, July 21, 2022, at 6:30 PM

Please note, a Quorum of voting Commissioners is required for an Administrative Hearing. If a Quorum of voting Commissioners is not present then a project status update will be given. Public comments will be heard. The Administrative Hearing will be rescheduled to a specified date and time.

Bernalillo County Public Works Division submitted a PHSZD online application to the Paradise Hills Special Zoning District Commission to construct sections of a sound attenuation wall on the properties described below. Your property is located within the Paradise Hills Special Zoning District notifications area. This letter is a notification of a PUBLIC MEETING and ADMINISTRATIVE HEARING to discuss the project for possible zoning permits. You are welcome to attend or send comments

Property Description: A Bernalillo County proposed project on multiple Paradise Hills Special Zoning District R-1 Single-family residential zoning classification property tracts on the west side of Unser Blvd between Irving Blvd and Paradise Blvd and located within the Paradise Hills Special Zoning District are the subject of the meeting. The applications are incomplete, but the Paradise Hills Special Zoning District

Commission will send Bernalillo County offices a notification of application omissions. The project boundaries of the proposed sound attenuation wall located on the eastern borders of the following Lots

Bernalillo County did not include properties on the east side of Unser also studied for a sound attenuation wall project. The sound attenuation wall segment location is private property classified as R-1 Residential.

Segments of the wall will be nine feet high. Individual agreements between Bernalillo County and respective property owners institute Bernalillo County with ongoing interest in the private property through Section 5, Bernalillo County Public Works Division Sound Wall Construction and Maintenance Agreement.

“Should Grantor fails to fulfill its obligations under paragraph 2 of this Agreement; then the County will send Grantor a notice of default and provide Grantor at least (30) days to remedy the default therein noted. If Grantors default continues following the thirty days notice, then Grantor may enforce the terms of this Agreement through all legal means, including seeking an injunction to force Grantor to fulfill the obligations herein described”;) The Paradise Hills Special Zoning District Comprehensive Ordinance Commission does not have a conforming permit, conditional use, or variance option within the existing R-1 Single Family Residential zoning classification. The PHSZD District Commission will be considering the proposal for a
